Is there a "blackbox" recorder in an E9x?

Is there a "blackbox" recorder that records the speed, steering direction, etc in an E9x? It could be used in a court if you have a serious accident...

I know that some Lexus have them.

They can't use it against you unless you grant them permission or so I'm told. It's some sort of right of privacy we have.

Most vehicles with airbags have them. By law most states require manufacturers to denote this in the manual. Look for "Event Data Recorder". In most cases they require permission from the owner or a court order. In cases involving fatalities/serious injuries especially DWIish, it would be a stretch to find a court not willing to order the extraction of such data.

It can record things like; highest rev, top speed, average sustained rpms, highest boost(not higher than OEM though if you have a piggyback Ive found), and other things. Even records how the car was broken in for the first 1200 miles.

While such a device does exist -- and this has nothing to do with BMW -- it is not necessarily installed and even then, it cannot be used unless an owner is notified prior to him/her taking over the car. Relax.

If you have an event data recorder, a court can definitely order its production, w/o owner consent. I do not know if BMWs have them, but many cars do and there have been cases where the info is used to refute a claim that the person on trial was traveling only X mph, when in reality they were going way faster than X.

I'm not privy to transcripts from U.S. case law but I seem to recall situations such as you describe as being inadmissable. Kind of like not being read your rights, no? I also recall a car manufacturer -- Cadillac? -- planning to install a data recorder but running afoul of civil liberties groups. Not 100% sure.
