I agree, if I'm walking in maybe that would be acceptable, but also I don't support price gouging. I'm not buying something from a street vendor where I'm bargaining for the price. The price was already established and they should stick with it. Anything else is greedy and cheap. They just realized now the car is going to be hot and decided to do that.

This type of sh!t aggravates the hell out of me.

I had a dealer I had been working w/ for over a year try and throw ADM at me and press me by giving me the whole act quick now sales pitch when allocation was announced.
Another dealer claimed $10k + and they weren't allowing any customer orders on the vehicle before delivery.. so their spec only.

I guess they aim to squeeze every dime out of whichever sucker falls into their web.

Gouging a few thousand to a dealership truly spoils what should be an exciting moment for a customer and could ultimatley build consumer / dealer relationship for future sales.

Thankfully, I found mine at MSRP fully configurable.

Good luck on finding the right one, they are still out there.

I would bail out on the deal honestly!

You can try to say you'll stick with it if they remove the ADM....otherwise, walk!

I think you will be able to find a used one or even maybe a new one in 6 months at under MSRP somewhere State side!

They are not selling out or in such high demand to command an ADM.

I think it depends on the contract, in most cases where you're putting a deposit down and you don't have a written agreement, I think it'll default to state law.

That being said I've had a few instances where dealers wanted to charge a non-refundable deposit for a custom order because they didn't want to get stuck with a hard-to-sell Individual color if I backed out, in that case I think that's a fair agreement.

The point is, is always get everything in writing. It sucks that the OP found themselves in this situation after being a loyal customer, I personally would badmouth him all over the internet and social forums and review websites and let their reputation get damage while taking my business elsewhere.

You can file a complaint to BMW NA and they'll actually contact the dealer to investigate any shady practices. Enough complaints and they'll force the dealership to fire the sales manager responsible.

Who knows, they may return the 5k. Worth a shot. Any time I've had to contact BMW NA they've been extremely responsive and helpful.

Why are you signing anything at this point? I've bought hundreds of cars and many ordered and never signed anything before delivery.

To those that said dealers do it because it works...are right. A sucker is born every minute.

I got my Comp at MSRP and I thought that was a great deal. A few months later they were letting them go for less when some demand subsided.

If that $5k markup was a last minute add-on after ordering the car or being on a waitlist, I would put them on blast all over social media and with anybody who would listen (Like BMW NA as suggested). Doubt the OP will do that since they were pretty demanding in their post but haven't responded to anybody.

I'm not sure why there isn't a thread that keeps track of dealerships that charge ADM. I would boycott them, but we are such a minority that it likely doesn't matter to them.

I'll give you one example...just like there are folks may who buy 2-3 homes a year to lease them out, etc. Someone may own a performance shop, buy cars, tune them and resell them after a short period of time or just showcase them to get business. I'm sure there are plenty of other examples. Not saying this is the case here...but just saying that not everyone on here buys cars for personal use.

Herb Chambers dealerships are awful..you would think a guy who got started because he was treated badly by a dealership early in his life would treat people better but he doesn't

I had an allocation south of Boston for MSRP that I didn't end up taking.. Probably no longer available but they only asked for MSRP no ADM.

Maybe off topic since this is technically "at (or below)", but I've just seen a new AW M2 CS at a Virginia dealership (on Autotrader) for $5k over MSRP.
