BMW voided my warranty

I wonder if anyone has experienced this problem. Having purchased my 2021 M2 in Oct 2021 my first dealer visit was for a clicking sound from the engine. What a horrific surprise when the mechanic called informing be I needed a new engine with only 17,000! Even worse was when they said BMW had voided the warranty in 6/2023 for over revving! For $38K they would replace the engine, but not under warranty! No evidence or history of problems per consumer web sites!! Can BMW be persuaded to cover the repair??

S55 are know to spin their crank hub. That is why smart member buy a pinned crank hub kit to prevent this problem.

BMW had to have been bleeding money in the last few years. Lately it seems hey're looking for every reason not to cover repairs under warranty.

What was the clicking sound diagnosed as? Do you have any more details?

so you are the og owner but they voided your warranty last year but did not tell you?

regardless this sucks, you could call corporate and see what the deal is and plea but most likely they will stick to their story. No way I would pay 38k for a new engine on a car that costs 50k, Id look for an indie to take a look personally

Not sure, they had record revenue I believe last year and a profit (EBIT) of 18.5 billion Euros not counting their Chinese joint venture hit.

I'm assuming it's a manual but hadn't you told me under certain circumstances a DCT can also be over revved?

That’s my plan. I’ll try BMW anyway. Case manager is to call within “1 to 5 days.”
Follow up quote was $23K for replacement of head, or $28K for replaced with used engine with 59K miles with a 6 mo warranty.
New engine would resume previous warranty to 6/2125.

So, they are claiming someone opened the engine, reinstalled the injectors without the dampeners, which eventually caused damage? I would request the car's service history if you can and see if BMW ever performed any service that required injectors to be pulled.

It's going to be an uphill battle with a car that has a recorded over-rev and missing parts.

BTW my car, which was totaled last month due to front end frame damage, has an 11k mile stock untuned S55 engine in it and the oil cooler was not ruptured during the accident. It also has the exhaust cam noise fix (bolts replaced). The engine is completely undamaged AFAIK and I even did extra oil changes on this car between BMW intervals. It will be auctioned on 4/19 by Copart in Sommerville, NJ. Chances are this entire car will be sold for less than BMW is asking for their S55 replacement for you. Unfortunately the assholes taking the pics at the yard left the windows open so there is some water on the seats in pics, but the car is mint otherwise and still smells new .

Yeah, by a tiny bit. BMW shouldn't even count those. I don't think Porsche would.

I'm curious about all this, especially about finding out when the warranty was voided for something that the dealership could do. I know for a fact I voided the warranty on our X5M with unlocked ECUs, and when an un-commanded over the air software update happened, the ECUs got bricked, but BMW still sent a factory rep to reprogram them. The update was BMW's fault I think, but I was honest and said I would have done the update at my house on wifi anyways. I did not know better with the unlocked tuned ECUs to not do that. BMW still helped me out.

I would push this up to BMW if you haven't tried yet. I don't how this company is with warranty repairs, but with other car makers, the dealer fronts the cost and gets compensated back by the manufacture. So maybe there's a disconnect there because the dealership doesn't think they'll get paid back? Good luck man, seems sketchy. Especially since the dealer could have over spun the motor. I wonder how that data is saved, is it time stamped?

BMW’s rep just called, and as expected, was no help at all. There was small print on the sales form from the selling Bentely dealer that stated, “All warranties expressed, implied, or written are expressly denied by the seller.”
Any attorneys on the forum that can tell me if this totally removes their liability?

I’m not a lawyer. Here are my thoughts tho.

If your sales paperwork states there’s no warranty, I think you’re fucked. It was a used car? So if you bought it thinking it was still covered under manufactures warranty, I think that would of been on you to verify that would still be valid. For that kind of stuff, I’m not sure about. I had bought a used BMW before from a Chevy dealership and it was still covered when I took it to a Bimmer dealer, although I think this particular 335 was a lease turn in CPO car that wasn’t selling so the Chevy dealer bought it. Lucky break I guess.

So you were denied for two reasons. Over revving? And then it was used and bently said no warranty. It seems fishy. Did the bently dealer know BMW had voided the coverage in that car? How did they communicate it? Car dealerships are scum. Every single one of them. All brands.

What you have is pretty standard. Dealers don't warranty cars, manufacturers do, which is why every sales order for new or used will have that there. Your only recourse is if the state you live in has a provision that the selling dealer must have a warranty in the event the factory one isn't valid. For example, the state of NY states that a dealer must warranty a vehicle they sell for 90 days or 3000 miles. Not sure how long you've had your car, and where you live but it would be worth looking into.
