Dealer wants to charge me $5,000 over MSRP after they took a $1000 deposit

My dealer contacted me saying that they want to charge me $5K over MSRP. We have a contract but it says price tbd :/ . We verbally agreed on MSRP and they took $1000 dollars . Its for a #3 allocation. What could I do. I am extremely pissed off!

Get your deposit back and tell him to pound sand. Then tell us what dealer so we know who to avoid.

We only have one 2016 M2 allocation for the foreseeable future and there are already offers for $15,000+ above MSRP. We are one of the few dealerships to still have an allocation available, most have been sold.

Reasonably sure it's their launch car and it was offered yesterday for 25k over. Guess they didn't get it. So now, they're down to 15k over.

I think Radrob818818818 is trying to say that his dealer tried to screw him too....He is basically pasting the text from his CA and he is NOT affiliated with the dealer.

OP - I agree with the first reply...if they value as a customer, they would not charge over MSRP after a gentleman's agreement.

I'm afraid this is going to be the norm moving forward. maybe not this much, buuuut.

my dealer moved away from ed msrp for ED. luckily I have it in writing. I started this process in May

Try the Costco buying program or something. Find another dealer ASAP. Get your money back, this car will be lower volume but you can get a car at a deal, no problem. 4 year build cycle Go buy a car, but don't buy into the BULLSHIT!

Now in the contract says price and specs tbd, but it also says in the price section 12,000$ , because when i had put my deposit down, price was not yet releases. Do you think I could get w lawyer and open a case demanding a sale price of $12,000? Could that make them back off? He just put in any number to fill in the sales price section.

Assuming you're close enough for PCD just get your $ back buy the car literally anywhere and go that route.

Thanks for the advice guys. Someone else said it on the same subject in a different thread "Its not the money , its the principle". I don't like to be made a fool. Im going to get on another dealership's list and this time learn from my stupid mistake and get MSRP in writing, and not just a gentleman's agreement. If the wait is too long I will go and get an M3 or M4 for below MSRP. Im just really pissed. By the way the dealership is BMW of Mt.Kisco, NY.

When I put my deposit down in May last year I got the number 1 slot and agreed to msrp whatever that ended up being. They put both my position in queue and msrp as the negotiated price in my receipt. Dealer called yesterday and honored both. I have a production number with my name on it. Tracking it in mybmw. I learned the hard way to get both in writing. I had a number 3 slot for a 1m and the dealer told me later they made a mistake and I was number 4. They only got allocated 3 so no 1m for me. Live and learn.

Never had luck with Mt. kisco, I'm from your area have a deposit for #2 at white plains,you should give them a call. hoping they don't come back with this markup, waiting to hear back from my sales guy.

Ya it's sad to say and Also bob smith bmw of calabasas said this We have one on order. Apparently they are going to be in very short demand and extremely limited.
The one we have on order will not be available for pre sale.
It is an Alpine White with Black Dakota leather interior, double clutch and executive pkg.
MSRP is $57,055.00 but I am being told that it will be offered for "over MSRP".

I am not sure how much yet.

I would get my deposit back. BMW is going to make many M2's in fact I was just reading an article where a BMW executive said they think the M2 is going to be a sales leader in its class. There is no reason to pay over MSRP and there is never a reason to do business with a dealer trying to exploit their customers. You may have to wait a couple more months but do business with a dealer that isn't trying to screw their customers. My dealer is huge and has been allocated only one car also, they expect in the coming weeks that they will start to get more allocation and that will happen on a regular basis. This is not the 1M Coupe despite the fact that some dealers are trying to play this as a one off car.
