I think it comes down to 2 main factors (assuming you're talking G8x):
-do you want 6MT or are you okay with auto
-how much do you care about saying you have the "competition"

The power difference is minor and can be made up in a $500 tune

I think for a lot of folks, it's not really a matter of $9000 more, but a few more bucks on the lease payment to drive the top trim (sort of). I think that makes the decision more palatable

New BMWs have a locked ecu. You can’t tune them.

No it won’t. Read the laws in the USA regarding this. I’ve done it and haven’t had a problem. The one time I was questioned, I supplied them with a copy of the law and my attorneys phone number. Know your rights and exercise them.

But they will not release the unlock to the public. So there is no real way to tune a current BMW.

As they are with each new generation. And in a year or two it will be possible to tune them just like every other modern BMW.

Not sure about CS but there are tuned M2C.

Not saying you are wrong but then what stops people from going nuts and forcing out hundreds of HP more that an engine is designed to output? Can I tune a M340 to a M3 power level and hold BMW responsible on its warranty claim?

The law says the dealer has to prove that a modification caused the failure. Obviously, at some point, if there’s too many modifications BMW isn’t going to be responsible. Small things like a tune, exhaust, and intake aren’t going to add so much horsepower to cause a problem.

Magnuson–Moss Warranty Act, it covers all warranties, not just for cars. It might take a while to get through it all.
