Brand new m2cs wont start bmw not covering the engine saying overreved $100k m2cs

So long story short i got a bmw m2cs and the car not starting on me anymore just cranks i took it to bmw monrovia and they check it out and they said that they wont cover the car because its engine overeved TOOK THEM 1 DAY IN THE SHOP TO TELL ME THAT. they sent me no proof just some stupid pics and videos and then on the bottom they sent me a bill for the new engine and want me to sign it for $45,000 when the car has full warranty from bmw and only has 13,000 miles on it and i even have extended warranty and i owe $93,000 on the car still!!! i just think its not right what they are doing and i never overreved the egine makes no sense i baby this car!

The car said drive train malfunction and then it didnt start

I just need some advice no what i should do get a lawyer or talk to a higher up and BMW because this is so wrong what they are doing and have shown no proof of what they have diagnosed the car as.

They literally just sent me these photos and thats it below.

Sounds like a bit of a "mark up" given the engine short block is ~$20k.

Going to be a long block. They need to boroscope each cylinder to see more. If the crank bolt was that loose thats real bad compared to just slipped. I can’t tell whats up with the filter. Is that supposed to be metal in it? If so the motor is done. Then you need to replace the oil coolers since debris will be in there ans flush the lines. If an over rev, that isn’t a warranty covered thing.

The DME can report an over-rev so if it did happen, the engine isn't covered. If it truly didn't happen you can always tow the car to another dealer.

Imagine i grab your face, look you directly in the eyes, and say this - “Drive it immediately into a tree. You WILL be on the hook for this. BMW will not fix it and your insurance will not cover it. You are about to be stuck with a dead car and a live loan. Insurance however DOES cover parking on a hill and forgetting the handbrake.”

You really need to get more info. Why is the crank bolt out, was it loose? Is this a spun crank hub gone really wrong? Ask for the DME report showing overrev. Is this a manual or a DCT? You need details and we would need details to help.

Yes its a manual. I asked them to send over a DME report i will post it on the thread as soon as i get it.

It does look like their is metal in it.. ill know more when i hear back from them.

Did you buy this car used? How long did you own the vehicle before this issue happened?

Definitely get proof that if it has been over revved. Filter is not showing anything from the pics. They need to take pics of the filter inside the combs.

If you in fact need a new engine I would get this.

"the DME was fully stock, and that it was only because of the over-rev, that they were giving me trouble in covering things. Completely ridiculous. They said it can be done on a DCT if you leave it in 1st in manual mode and bang into the rev limiter, or if you have the traction control full off and floor it. Cannot confirm or deny that either of those things happened..."
