They can't do that mate, it's not your fault, it's their fault.
You purchased it from BMW used with a remainder of the manufacturers new car 3yr warranty, it's their mistake they didn't spot the "modifications" done by a previous owner.
They take responsibiity for the car when they buy and sell it on.
I'd confront them about it, or take legal advice.
...but if they agree to warranty they'll want to reprogram the DME which will block your tuning...
