The rules vary state by state. Some states require DV be honored if requested, with formal processes, others have no obligation. My dad had success when his Cayenne GTS was hit by a DE resident. I had no success when I was hit by an underinsured PA resident. I had to lawyer up, the guy I hired lost and tried to come back to me for payment for his services. It was a tremendous headache.
