I don't understand what you want the dealer to do? When there is little space things will get caught. Ask anyone with big brakes and low wheel clearance. It's not BMW specific. If you didn't want this issue, should have gotten the blue brakes (since your in the UK).

To me, it's like saying that it's BMW's fault all season tires suck in the snow. No, any car's all season tires will suck in the snow. If you want tires that can handle the snow better, get snow tires. If you don't want things to get stuck, get the smaller brake option, or get bigger wheels.

I get your frustration, but it's one of those things people with big brakes and low clearance have to deal with brand irrespective.
