I'm going to go ahead and say no, it's likely not enforceable, nor am I sure it's legal. The hard thing here is that there is probably no public change-log of said warranty, so unless a savvy tune purchaser downloaded a copy of it beforehand, they likely will just have to lube up and take it from Noelle.
