I think it's tied to either being in park on with the handbrake applied as BMW doesn't want the liability of the seat moving with one touch while the car can potentially be driven/moving. An example would be in position 1 is your position and position 2 is someone much taller or shorter than you. If you accidentally hit position 2 while the vehicle is in motion, the seat would be moving into a position where you can't safely control the car anymore.
