95 miles is too much for me. Dealers, especially in SoCal are selling these at MSRP. If they are giving you $3k that's all you need to know about the undesirability of that car new with that many miles on it.
Also, the deposit thing they told you is complete bullshit. By law they MUST give you your deposit back on request with no conditions.
