I'm not privy to transcripts from U.S. case law but I seem to recall situations such as you describe as being inadmissable. Kind of like not being read your rights, no? I also recall a car manufacturer -- Cadillac? -- planning to install a data recorder but running afoul of civil liberties groups. Not 100% sure.
