Yup, I would have them take the car back and tell them they sold it to you like that.
If they don't take it back, I'd call BMW NA and tell them what the dealer did.
Tell them they sold it to you CPO with the catless pipes.
BMW NA doesn't BS around, i'm pretty sure they'd chew the dealer a new one if they found out.
