Warranty/Dealership Dispute - Assistance Required

I bought a 2018 OG M2 from a Nissan dealership in February. I also purchased a 1 year warranty through them - its a generic company that handles warranty's, service plans and insurance, they are quite well known in the UK (EMAC).

Put the car into the local BMW dealership for a MOT and minor service, its come back with the following issues:

1. Horn requires replacement
2. Rear indicator malfunction (the dreaded 2 series known issue)
3. Balljoint, KDS and suspension arm replacement

Advised them I had a warranty and gave the details expecting 1 & 2 to be covered, 3 sounds like wear and tear. EMAC have come back advising warranty is void as log print outs show the engine has been tuned and the ECU remapped.

This is news to me, first I heard of it - wasn't told this when I purchased the car.

BMW are speaking to Nissan on my behalf (part of same motor group franchise). So I've been sold a modified car I had no idea about, which has in turn voided the warranty they sold me (so the warranty was void from day 1 in any case) and I'm now likely liable for these faults after just 8 months of ownership. Unknowingly driving a modified car which has voided parts they may otherwise have fixed under warranty and my car insurance will likely be void as well given I haven't declared the mod as I didn't know about it.

I feel none of this is through any fault of my own, I must be entitled to something as the customer here? At a minimum I'd expect the cost of the warranty to be refunded given I was never eligible for it.

Any thoughts on this or advise welcomed. Still waiting the full results of the 2 dealerships discussing this and the appeal for the warranty claim.

Warranty company have declared the warranty void as a result of the engine mod.

Nissan have agreed to pay the cost of fixing the suspension and removing the mod. I've asked about the cost of the warranty which was never valid, the lights and the horn. The manager who can make this decision is out till Monday.

One thing I'd try to do if I were you is pull the DME flash date for your records. It should show that the DME was modified/flashed before you bought it thus proving that they sold you a tuned vehicle without your knowledge.
